CheckD Data Processing Agreement

Users own their data stored in the Dataswyft Wallet and the HAT microserver it resides upon.  This agreement gives permission for Dataswyft to process the data as instructed by the User.

Terms

The parties agree for the purposes of importing data into, processing data within, and sharing data from the User’s wallet (and on the HAT microserver it resides upon) the User shall act as controller and Dataswyft will act as the processor.

Processing of the Protected Data by Dataswyft shall be for the subject-matter, duration, nature and purposes and involve the types of Personal Data and categories of Data Subjects set out in this agreement.

The parties agree that instructions for processing data (including importing, sharing, and retrieving and display of data) may be communicated from the User to Dataswyft through use of the CheckD website in its normal fashion.

The User warrants that data processing they instruct DataSwyft to perform (via the CheckD website or via other means) is compliant with Data Protection legislation, including but not limited (i) to the the Directive 95/46/EC (Data Protection Directive), or the GDPR, or the PDPL; ii) any laws which implement such laws; iii) any laws that replace, extend, re-enact, consolidate or amend any of the laws stated in (i) and (ii) above; iv) all guidance, codes of practice and codes of conduct issued by any relevant Data Protection Supervisory Authority relating to such Data Protection Laws (whether legally binding or not).

The User permits Dataswyft to assign sub-processors to process data.

Dataswyft will not share data it is processing with third parties except (a) under the instruction of the User (b) to sub-processors for the purpose of processing under this agreement (c) where it is required by any applicable law, regulation or public authority. 

Data Processing

Subject-matter of processing: Badge data and related data.

Duration of the processing: Data will be processed only for the duration required to carry out the specific instruction of the User.

Nature and purpose of the processing: Processing data necessary for badge operations

Type of Personal Data: All data relating to the User requesting the processing.

Categories of Data Subjects: The User themselves.
